C. YOUR FINANCE

1. Deposits

1.1 You may only join the fantasy league game with the amount of cleared funds held in your account. Accordingly, if you want to participate in gaming, you must deposit monies into your account. 4.1 If we incur any charge-backs, reversals or other charges in respect of your account, we reserve the right to charge you for the relevant amounts incurred.

4.3 You are responsible for reporting your winnings and losses to the tax and/or other authorities in your jurisdiction.

D. GAMING PROCEDURES

1. Contesting/Participating

1.1 Batball11 reserves the right to decline all, or part, of any League requested at its sole and absolute discretion. All Leagues are placed at your own risk and discretion.

2. League/Participation Confirmation

2.1 Leagues/Participation will not be valid if there are insufficient funds in your account.

2.2 Leagues/Participation that you request will only be valid once accepted by Batball11’s servers. Each valid League/participation will receive a unique transaction code. We shall not be liable for the settlement of any League/participation which are not issued with a unique transaction code. 2.3 Notwithstanding the above, if League/participation is placed via a credit or debit card they are not valid until we have received payment in full. The League/participation will be automatically void if we have not received the payment prior to the relevant event commencing.

Users are to carry proper research of their own from official sources and/or other available sources of information. Batball11, shall not take any liability, if a player earlier indicated as 'Playing' does not play and or player earlier indicated as “not playing” does actually play for any reason whatsoever. In-case of any differences in the line-up either from Batball11’s data source or official source, contest will continue as scheduled.

3. Offers

3.1 Where any term of an offer or Offer is breached or there is any evidence of a series of participation by a customer or group of customers, which due to enhanced payments, Free leagues, risk free leagues, gaming Credits, Rewards or any other Promotional offer results in guaranteed customer profits irrespective of the outcome, whether individually or as part of a group, Batball11 may reclaim the enhanced payment, Free leagues, risk free leagues or gaming Credits of such offers and/or void any League funded by the Free Credits. In addition, where there is evidence of such activity, Batball11 may levy an administration charge on the customer up to the value of the Credits, Free Reward or enhanced payment towards the administrative costs incurred in identifying and taking action against the activity.

3.2 Batball11 may reclaim any Reward amount, freecredits, league Credits or enhanced payments that have been awarded in error.

3.3 All customer offers are limited to one per person. If Batball11 has reasonable grounds to suspect that a Reward or offer is being claimed by or for the benefit of the same person more than once or by a group of people then it may withdraw the availability of any offer or all offers to that customer or group of customers and/or void any League funded by the Reward or offer and remove any winnings from such participation in fantasy gaming.

3.4 Batball11 may, at any time, make minor amendments to the terms and conditions of any offer or Offer to correct typographical errors or to improve on clarity or customer experience and may cancel any offer or Offer for legal or regulatory reasons.Batball11 has and shall take all reasonable care but the user agrees and indemnifies Batball11 and in a situation of any error Batball11 shall be held indemnified for any and all typographical errors.

4. Settlement and Payouts

4.1 All league and participation in the fantasy league and Leagues are subject to the applicable legal provisions (including maximum winnings) applicable in the concerned States and these Terms and Conditions shall be bound by the same.

4.2 Batball11 reserves the right to suspend and/or cancel any League/league at any time. When a League is suspended any participation entered will be rejected. Batball11 also reserves the right to cease fantasy gaming on any league at any time without notice.

4.3 Winnings from Leagues are added to the balance of your gaming account. Any funds/winnings credited to an account in error are not available for use, and Batball11 reserves the right to void any transactions involving such funds and/or withdraw the relevant amount from your account and/or reverse the transaction, either at the time or retrospectively.

4.4 Where there is evidence of a series of Leagues each containing the same selection/s having been placed by or for the same individual or syndicate of individuals, Batball11 reserves the right to make Leagues void or withhold payment of returns pending the outcome of any subsequent investigation. Investigation would also cover internal inquiry and investigation.

4.5 If for any reason we are unable to validate the outcome of a particular League (e.g. due to loss of live pictures), all Leagues will be void, unless settlement of League is already determined.

4.6 Where a user gives ambiguous instructions, Batball11 reserves the right to split the amount of monies staked League/league between the potential outcomes. Where this is impractical we reserve the right to void the whole of that League. In any event, the decision of Batball11 is final.

3. Fair Use

3.1 The Website/Mobile Application and Batball11 products may only be used for the purposes of participating in Leagues/leagues and on events and/or gaming products.

3.2 You must not use the Website/Mobile Application for the benefit of a third party or for any purpose which (in Batball11’s opinion) is illegal, defamatory, abusive or obscene, or which Batball11 considers discriminatory, fraudulent, dishonest or inappropriate.

3.3 Batball11 will seek criminal and contractual sanctions against any customer involved in fraudulent, dishonest or criminal acts via or in connection with the Website/Mobile Application or Batball11's products. Batball11 will withhold payment to any customer where any of these are suspected or where the payment is suspected to be for the benefit of a third party. The customer shall indemnify and shall be liable to pay to Batball11, on demand, all Claims (as defined in paragraph B.4.3 above) arising directly or indirectly from the customer’s fraudulent, dishonest or criminal act.

4. Software and Technology Issues

4.1 In order for you to use certain products offered on the Website/Mobile Application you may need to download some software. Also, certain third party product providers may require you to agree to additional terms and conditions governing the use of their products. 4.3 We hereby grant to you a personal, non-exclusive, non-transferable right to use the relevant software, for the sole purpose of using/playing products on the Website/Mobile Application, in accordance with the following provisions. 5.2 Batball11 does not accept any liability in respect of any third party feeds, commentaries and content.

5.3 Batball11 does not allow any employee, anyone else in any way connected to such employee or anyone otherwise connected to a third party service provider (to be determined in Batball11’s absolute discretion) to League/league on any event where the third party service provider is providing a service to Batball11. Batball11 will void any League/league where it determines in its absolute discretion that such fantasy gaming has taken place.

5.4 Where the Website/Mobile Application contains links to third party Website/Mobile Applications and resources, these links are provided for your information only. Batball11 has no control over the content of these sites or resources, and accepts no liability for them or for any loss or damage that may arise from your use of them. The inclusion of a link to a third party Website/Mobile Application does not constitute an endorsement of that third party’s Website/Mobile Application, product or services (if applicable).

6. Other

6.1 Batball11 actively monitors traffic to and from the Website/Mobile Application. Batball11 reserves the right in its sole discretion to block access where evidence indicative of automated or robotic activity is found.

6.2 Batball11 reserves the right to restrict access to all or certain parts of the Website/Mobile Application in respect of certain jurisdictions.

6.3 Batball11 may alter or amend the products offered via the Website/Mobile Application at any time and for any reason.

6.4 From time to time, all or part of the Website/Mobile Application may be unavailable for use by you because of our maintenance of the Website/Mobile Application and/or alteration or amendment of any of the Website/Mobile Application products.

6.5 A malfunction or error in a gaming product will void all applicable stakes and returns.

F. OUR LIABILITY

1. Batball11 does not accept any liability for any damages, liabilities or losses which are deemed or alleged to have arisen out of or in connection with the Website/Mobile Application or its content (including delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person's misuse of the Website/Mobile Application or its content or any errors or omissions in content).

3. Batball11’s total aggregate liability to you under or in connection with these Terms and Conditions does not exceed:

1. the value of the Leagues/leagues and/or you placed via your account in respect of the relevant League/league or product that gave rise to the relevant liability; and
2. the amount of applicable monies, where such monies have been misplaced by us.
3. Rs.50 or the amount of League, whichever is lower, in respect of any other liability.

4. Batball11 shall not be liable, in contract, tort (including negligence) or for breach of statutory duty or in any other way for any of the following (whether incurred directly or indirectly): (a) loss of profits; (b) loss of business;(c) loss of revenue;(d) loss of opportunity;(e) loss of data;(f) loss of goodwill or reputation; or(g) any special, indirect or consequential losses, whether or not such losses were within the contemplation of the parties at the date of these terms and conditions.

5. Nothing in this Section F shall limit Batball11's liability to pay the genuine winnings or other sums properly owing to it, subject always to terms and conditions set out herein and the maximum winnings to these Terms and Conditions.

6. Nothing in these Terms and Conditions shall exclude or limit Batball11’s liability for:

1. death or personal injury caused by Batball11’s negligence;
2. fraud or fraudulent misrepresentation; or
3. any liability which cannot be excluded or limited under applicable law.

G. OUR INTELLECTUAL PROPERTY RIGHTS

If you make use of a feature that allows you to upload material, information, comments, postings or other content to the Website/mobile application ("User Content"), then the User Content will be considered to be non-confidential and non-proprietary and Batball11 has the right to use, copy, distribute and disclose to third parties any User Content for any purpose. Batball11 shall not be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform, any of its obligations if such delay or failure results from events, circumstances or causes beyond its reasonable control including (without limitation) any telecommunications/internet/mobile network failures, power failures, failures in third party computer hardware or software, fire, lightning, explosion, flood, severe weather, industrial disputes or lock-outs, terrorist activity and acts of government or other competent authorities. In such circumstances the time for performance shall be extended by a period equivalent to the period during which performance of the obligation has been delayed or failed to be performed.

8. Batball11 may assign, transfer, charge, sub-license or deal in any other manner with these Terms and Conditions, or sub-contract any of its rights and obligations under these Terms and Conditions, to any party including any company within or outside the Batball11 group.

9. Any notice to be given under these Terms and Conditions must be in writing, in English and may be served by hand delivery, speed post, recorded delivery or registered post or email to: (a) in the case of Batball11, the address of the relevant Batball11 company as set out at the beginning of these Terms and Conditions or as displayed on the Website; and (b) in respect of notices given by Batball11 to you, pursuant to the customer registration procedure (including any amendment to those details you have notified to Batball11). Any notice shall be deemed to have been received: (a) if delivered by hand, at the time of delivery; (b) if sent by first class post, recorded delivery or registered post, at 09.30 (GMT) on the seventh clear day after the date of posting; (c) if sent by pre-paid registered airmail, at 09.30 (GMT) on the fifteenth clear day after the date of posting; and (d) if sent by email, 24 hours from the time of sending.

10. The Appendices, the Privacy Policy, the Cookies Policy, the Rules and any document expressly referred to in them and any guidelines or rules posted on the Website form an integral part of these Terms and Conditions and shall have effect as if set out in full in the body of these Terms and Conditions. In the event of any inconsistency between the main body of these Terms and Conditions and the Appendices, the Privacy Policy, the Cookies Policy, the Rules and/or any document expressly referred to in them and any guidelines or rules posted on the Website, unless stated otherwise, the main body shall prevail.

I. COMPLAINTS, DISPUTES, GOVERNING LAW AND JURISDICTION

1. Should there be any claim or dispute arising from a past or current transaction, please contact us. If Batball11 is unable to settle the dispute, either party is entitled to refer the dispute to an Sole Arbitrator, to be appointed by Batball11, whose seat would be at Ahmedabad, Gujarat and whose decision will be final (save in respect of any manifest error) subject to full chance of representation given to all parties involved. No dispute regarding any fantasy League, league or game will result in litigation, court action.

2. Subject to paragraph B.3.1 above, these Terms and Conditions and any dispute or claim arising out of or in connection with it or its subject matter, whether of a contractual or non-contractual nature, shall be governed by and construed in accordance with the laws of India. The courts of competent jurisdiction at Ahmedabad shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Batball11 Services provided by Batball11 (including the League/s), the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the User/s (including Participants) or Batball11, as well as the exclusive jurisdiction to grant interim or preliminary relief in case of any dispute referred to arbitration as given below. All such issues and questions shall be governed and construed in accordance with the laws of the Republic of India.

3. In the event of any legal dispute (which may be a legal issue or question) which may arise, the party raising the dispute shall provide a written notification ("Notification") to the other party. On receipt of Notification, the parties shall first try to resolve the dispute through discussions. In the event that the parties are unable to resolve the dispute within fifteen (15) days of receipt of Notification, the dispute shall be settled by arbitration. The arbitration award will be final and binding on the Parties, and each Party will bear its own costs of arbitration and equally share the fees of the arbitrator unless the arbitral tribunal decides otherwise. The arbitrator shall be entitled to pass interim orders and awards, including the orders for specific performance and such orders would be enforceable in competent courts. The arbitrator shall give a reasoned award.

4. Nothing contained in these Terms and Conditions shall prevent Batball11 from seeking and obtaining interim or permanent equitable or injunctive relief, or any other relief available to safeguard Batball11's interest prior to, during or following the filing of arbitration proceedings or pending the execution of a decision or award in connection with any arbitration proceedings from any court having jurisdiction to grant the same. The pursuit of equitable or injunctive relief shall not constitute a waiver on the part of Batball11 to pursue any remedy for monetary damages through the arbitration described herein.

5. By accepting these Terms and Conditions and/or participating in Leagues/leaguesor and/or making use (whether authorized or not) of the facilities offered by Batball11 (whether through the Website/mobile app or otherwise) and/or by using, visiting and/or accessing any part (including, but not limited to, sub-domains, source code and/or website APIs, whether visible or not) of the Website or mobile app, you irrevocably agree that the courts of India shall have exclusive jurisdiction to settle any dispute which may arise out of or in connection with these Terms and Conditions. Notwithstanding the foregoing, Batball11 shall be entitled to bring a claim against a customer in the court of the customer's country of domicile.

J. LEAGUE PAYMENT TERMS AND CONDITIONS

The terms "We" / "Us" / "Our"/”Company” individually and collectively refer to Batball11 and the terms "Visitor” ”User” refer to the users.

User agrees that neither Company nor its group companies, directors, officers or employee shall be liable for any direct or/and indirect or/and incidental or/and special or/and consequential or/and exemplary damages, resulting from the use or/and the inability to use the service or/and for cost of procurement of substitute goods or/and services or resulting from any goods or/and data or/and information or/and services purchased or/and obtained or/and messages received or/and transactions entered into through or/and from the service or/and resulting from unauthorized access to or/and alteration of user's transmissions or/and data or/and arising from any other matter relating to the service, including but not limited to, damages for loss of profits or/and use or/and data or other intangible, even if Company has been advised of the possibility of such damages.User further agrees that Company shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct or/and indirect or/and incidental or/and special consequential or/and exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent user agrees that Company shall not be responsible or liable to user, or anyone, for the statements or conduct of any third party of the service. In sum, in no event shall Company's total liability to the User for all damages or/and losses or/and causes of action exceed the amount paid by the User to Company, if any, that is related to the cause of action.

2.5 Disclaimer Of Consequential Damages

K. REGISTRATION

In order to register for the League/s, Participants are required to accurately provide all information, not limited to; i)Full Name; ii)Mobile Number; iii)Team Name/s; iv)E-mail address/Password; vi)State of Residence, if Indian Resident; vii)Gender; viii)Date of birth etc., and Participants are also required to confirm that they have read, and shall abide by, these Terms and Conditions. In the event a Participant indicates, while entering an address, that he/she is a resident of either Assam, Odisha, Telangana,Karnataka, Nagaland or Sikkim, or residing in the State which does not allow fantasy gaming then such Participant shall not participate in the League as he will not be permitted to proceed to sign up for any round in the paid version of the League as described below. Once the Participants have entered the above information, and clicked on the "register" tab, and such Participants are above the age of 18 years, they are sent an email confirming their registration and containing their login information. The Software is licensed to you for your private personal use. Please note that the Software is not for use by (i) individuals under 18 years of age, (ii) individuals under the legal age of majority in their jurisdiction and (iii) individuals connecting to the Site from jurisdictions from which it is illegal to do so. BB11 is not able to verify the legality of the Service in each jurisdiction and it is the User's responsibility to ensure that their use of the Service is lawful.

L. LEAGUE /s, PARTICIPATION & PRIZES

As part of its services Batball11 may make available the following League/s on the platform. The Leagues that are made available on the platform are of fantasy cricket game. Individual users wishing to participate in the such League "Participants" are invited to create their own fantasy teams consisting of real life cricketers, involved in the real-life cricket match, series or tournament "Event" to which the fantasy game relates. Batball11 offers its platform to Participants for fantasy game League/s being created relating to each Event, and Participants can participate in such League/s with their Teams. Teams are awarded points on the basis of the real life cricketers' performances at the end of a designated match, round or tournament of the League/s. The Participant/s whose Team/s have achieved the highest aggregate score/s in the League/s shall be declared winners. In certain pre-specified Leagues, there may be more than one Winner and distribution of prizes to such Winners will be in increasing order of their Team's aggregate score at the end of the designated round/s of the Leagues. The League/s across the Batball11 Services shall, in addition to the Terms and Conditions, rules and regulations mentioned herein, be governed by:"Fantasy Rules" available at How To Play - Fantasy Cricket or other rules and regulations (including rules and regulation in relation to any payments made to participate in the League/s; and all Participants agree to abide by the same.Currently, there are paid versions of the League/s made available on Batball11 platform. Users may participate in the League/s by paying the pre-designated amount as provided on the relevant League page. The ‘pre-designated amount’ means and includes pre-determined platform fee for accessing Batball11 services and pre-determined participant's contribution towards prize money pool. The Participant with the highest aggregate points at the end of the pre-determined round shall be eligible to win a pre-designated prize which is disbursed out of prize money pool, as stated on the relevant League/s page.A Participant may create different Teams for participation in League/s in relation to a Sport Event across the Batball11 Services. However, unless Batball11 specifies otherwise in relation to any League ("Multiple Entry League"), Participants acknowledge and agree that they may enter only one Team in any League offered in relation to a Sport Event. In case of Multiple Entry League/s, a Participant may enter more than one Team in a single Multiple Entry League. In addition, it is expressly clarified that Batball11 may, from time to time, restrict the maximum number of Teams that may be created by a single User account (for each format of the League) or which a single User account may enter in a particular Multiple Entry League, in each case to such number as determined by Batball11 in its sole discretion.Participant shall pay a pre-designated amount for participating in the League/s being created on the Batball11 platform. In the event a Participant indicates, while entering an address, that he/she is a resident of either Assam, Odisha, Telangana, Karnataka, Nagaland or Sikkim or as per the prevalent laws of each state and such Participant will not be permitted to proceed to sign up for the round or League and may not participate in any paid version of the League/s.

M. LEAGUE FORMAT

Currently two formats of League/s are made available on Batball11 platform (1) Public League where Users can participate in a League with other Users without any restriction on participation and (2) private Leagues, where Users can invite specific Users into a League and restrict participation to such invited Users. All rules applicable to League/s as set out herein shall be applicable to both formats of the League/s.

1. Public League

In the Public League format of the League/s, Batball11 may make available the League/s comprising of 2 Participants, 3 Participants, 5 Participants, 10 Participants, 100 Participants or any other pre-designated number of Participants.Batball11 may create this format of the League/s as a paid format and the Winner will be determinable at the end of the round as per rule of the Leagues.The number of Participants required to make the League/s operational will be pre-specified and once the number of Participants in such League/s equals the pre-specified number required for that League/s, such League/s shall be operational. In case the number of Participants is less than the pre-specified number at the time of commencement of the round, such League/s will not be operational and the pre-designated amount paid by each Participant shall be returned to the account of such User without any charge or deduction.In certain Leagues across the Batball11 Services, designated as "Confirmed Leagues", the League/s shall become operational once the number of Participants in such League /s equals the pre-specified number of winners to be declared in such League/s, even if all available Participant slots (as pre-specified in relation to the League/s) remain unfilled. It is clarified that notwithstanding the activation of such League/s, Participants can continue to join such League/s till either (i) all available Participant slots of such League/s are filled or (ii) the round to which the League /s relates commences, whichever is earlier. In case such League/s is not operational by the time of the commencement of the round, the pre-designated amount paid by each Participant shall be returned to the account of such User without any charge or deduction. Batball11, however, reserves the right to designate any League as ‘confirmed League’, at any point in time, at its sole discretion.

2. Private League

In the Private League format of the League/s, Batball11 enables Users to create a League ("Private League") and invite other users, whether existing Users or otherwise, ("Invited User") to create Teams and participate in the League/s. Users may create a Private League to consist of a pre-specified number of Participants, that is, consisting of either 2 Participants, 3 Participants, 5 Participants or 10 Participants. The User creating the Private League shall pay the pre-designated amount for such Private League and thereby join that Private League, shall supply a name for the Private League and be provided with a unique identification code ("League Code") (which will be issued to the account of such User). The User agrees and understands that once the Private League is created no change shall be permitted in the terms or constitution of the Private League, except for a change in the name of the League. The User creating the Private League shall provide Batball11 with the email address or Facebook account username of Invited Users to enable Batball11 to send a message or mail inviting such Invited User to register with Batball11, if necessary, and participate in the Private League in relation to which the invite has been issued.In order to participate in the Private League, an Invited User shall input the League Code associated with the Private League and pay the pre-designated amount for the Private League. Once the number of Participants in a Private League equals the number of pre-specified Participants for that Private League, the Private League shall be rendered operative and no other Invited Users or Users shall be permitted to participate in the Private League. In the event that any Private League does not contain the pre-specified number of Participants for that Private League within 1 hour prior to the commencement of the round/League, the Platform will initiate an automatic refund of the amount deposited. Such refund shall be processed after the expiry of the deadline for filling of participants for such Private League.It is clarified that the participation of Invited Users in any Private League is subject to the pre-specified number of Participants for that Private League, and Batball11 shall not be liable to any person for the inability of any Invited User to participate in any Private League due to any cause whatsoever, including without limitation due to a hardware or technical malfunction or lack of eligibility of such Invited User to participate in the League/s.

3. Cancellation Policy

The following Refund and cancellation policy and the terms of Batball11 would be final.Our focus is complete customer satisfaction. In the event, in case any payment which needs to be refunded as per the terms and conditions of Batball11 or, we will refund back the money, provided the reasons are genuine and proved after our internal investigation. Please read the fine prints of terms and conditions of Batball11 before using it, it provides all the details about the services.

In case of dissatisfaction from our services, clients have the liberty to cancel their usage/ membership of the app/website and request a refund in case of any balance in fantasy gaming account, from us. Our Policy for the cancellation and refund will be as follows:

For Cancellations please contact us via contact us link. Requests received later than 7 business days prior to the end of the current service period will be treated as cancellation of services for the next service period.

4. Refund Policy

We will try our best to create the suitable design concepts for our clients. If paid by credit card, refunds will be issued to the original credit card provided at the time of purchase and in case of payment gateway name payments refund will be made to the same account.

N. LEGALITY & GAME OF SKILL

Games of skill are legal, as they are excluded from the ambit of Indian gambling legislations including, the Public Gambling Act of 1867.The Indian Supreme Court in the cases of State of Andhra Pradesh v. K Satyanarayana (AIR 1968 SC 825) and KR Lakshmanan v. State of Tamil Nadu (AIR 1996 SC 1153) has held that a game in which success depends predominantly upon the superior knowledge, training, attention, experience and adroitness of the player shall be classified as a game of skill.The League /s described above (across the Batball11 Services) are games of skill as success of Participants depends primarily on their superior knowledge of the game of cricket,its statistics, knowledge of players' relative form, players' performance in a particular territory, conditions and/or format (such as ODIs, test cricket and Twenty20 in the cricket fantasy game), attention and dedication towards the League/s and adroitness in playing the League/s. The League/s also requires Participants to field well-balanced sides with limited resources and make substitutions at appropriate times to gain the maximum points.By participating in this League/s, each Participant acknowledges and agrees that he/she is participating in a game of skill.

O. ELIGIBILITY

The League/s are open only to persons above the age of 18 years, currently residing in India.Batball11 may, in accordance with the laws prevailing in certain Indian states, bar individuals residing in those states from participating in the League/s. Currently, individuals residing in the Indian states of Assam, Odisha,Telangana,Karnataka,Nagaland or Sikkim shall not participate in the paid version of the League as the laws of these states bar persons from participating in games of skill where participants are required to pay to enter.Persons who wish to participate must have a valid email address.Only those Participants who have successfully registered on the Batball11 as well as registered prior to each round in accordance with the procedure outlined above shall be eligible to participate in the League and win prizes.

P.TAXES PAYABLE

All prizes shall be subject to deduction of tax ("TDS") as per the Income Tax Act 1961. As of April 1, 2018, the TDS rate prescribed by the Government of India with respect to any prize money amount that is in excess of Rs. 10,000/- is 31.2% of the total prize money amount. In case of any revisions by the Government of India to the aforementioned rate in the future, TDS will be deducted by Batball11 in accordance with the then current prescribed TDS rate. Winners will be provided TDS certificates in respect of such tax deductions. The Winners shall be responsible for payment of any other applicable tax, including but not limited to, income tax, gift tax, etc. in respect of the prize money.

Q. TABULATION OF FANTASY POINTS

Batball11 may obtain the score feed and other information required for the computation and tabulation of fantasy points from third party service provider/s. In the rare event that any error in the computation or tabulation of fantasy points, selection of winners, etc., as a result of inaccuracies in or incompleteness of the feed provided by the third party service provider comes to its attention, Batball11 shall use best efforts to rectify such error prior to the distribution of prizes. However, Batball11 hereby clarifies that it relies on the accuracy and completeness of such third party score/statistic feeds and does not itself warrant or make any representations concerning the accuracy thereof and, in any event, shall take no responsibility for inaccuracies in computation and tabulation of fantasy points or the selection of winners as a result of any inaccurate or incomplete scores/statistics received from such third party service provider. Users and Participants agree not to make any claim or raise any complaint against Batball11 in this respect.

In your each Fantasy team MM (Man of the Match) will get 3x Points, C (Captain) will get 2x Points and Vc (Vice Captain) will get 1.5x Points, In your fantasy team if you have selected the player which is not part of Playing XI of real life match and if he play as substitute player while real match it'll not be awarded any points in your fantasy team, To facilitate users to make better choice and timely change in any of players in their respective fantasy team we will provide green colored indicative next to player announced by team in real match scenario as part of starting lineup (Playing XI) and red colored indicative for player is not part of starting lineup (Playing XI) in real match scenario. Batball11 does not accept any liability for any damages, liabilities or losses which are deemed or alleged to have arisen out of or in connection with the Website/Mobile Application or its content (including delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person's misuse of the Website/Mobile Application or its content or any errors or omissions in content. No Points will be awarded for your fantasy team in the event of Super Over. Bonus points are awarded only for the highest achievement of any player.

Substitutes on the field will not be awarded points for any contribution they make. However, Concussion and COVID-19 Substitutes (if permitted as per the applicable rules and regulations of the tournament) will be awarded 4 points for making an appearance in matches (only for T20s, ODs, Tests and T10s) and will be awarded points for any contribution they make as per the Fantasy Points System.

If a player is announced in the starting eleven of a team but later is unable to start the match, he/she will not score any points. The player who plays as the replacement, however, will earn points for the match (including starting points).

Data is provided by reliable sources and once the match has been marked as completed i.e., winners have been declared, no further adjustments will be made. Points awarded live in-game are subject to change as long as the match status is 'In progress' or 'Waiting for review'.

More than 11 players from either team are allowed to play in Other OD/Other T20/Other Test matches.

All the X-Factor substitutes will get 4 points for being announced and will also score points for any contributions they make as per our Fantasy Point System.

Substitutes other than Concussion substitutes, COVID-19 substitutes or X-Factor substitutes will not be awarded points for any contribution they make.

In the Big Bash League, if a player gets replaced by an X-Factor substitute, but later comes back on field, he will get points for his contributions. However, if a player, who was not a part of the announced lineups, comes to the field as a substitute, he will not get points for any of his contributions (except Concussion and COVID-19 substitutes).

R. MISCELLANEOUS

The decision of Batball11 with respect to the awarding of prizes shall be final, binding and non-contestable. Participants playing the paid formats of the League/s confirm that they are not residents of any of the following Indian states - Assam, Odisha, Telangana, Nagaland or Sikkim. If it is found that a Participant playing the paid formats of the League/s is a resident of any of the abovementioned states, Batball11 shall disqualify such Participant and forfeit any prize won by such Participant. Further Batball11 may, at its sole and absolute discretion, suspend or terminate such Participant's account with Batball11. Any amount remaining unused in the User's Game Account or Winnings Account on the date of deactivation or deletion shall be reimbursed to the User by an online transfer to the User's bank account on record with Batball11, subject to the processing fee (if any) applicable on such transfers as set out herein.

If it is found that a Participant playing the paid formats of the League/s is under the age of eighteen (18), Batball11 shall be entitled, at its sole and absolute discretion, to disqualify such Participant and forfeit his/her prize. Further, Batball11 may, at its sole and absolute discretion, suspend or terminate such Participant's account.

To the extent permitted by law, Batball11 makes no representations or warranties as to the quality, suitability or merchantability of any prizes and shall not be liable in respect of the same. Batball11 may, at its sole and absolute discretion, vary or modify the prizes being offered to winners. Participants shall not raise any claim against Batball11 or question its right to modify such prizes being offered, prior to closure of the League. Batball11 will not bear any responsibility for the transportation or packaging of prizes to the respective winners. Batball11 shall not be held liable for any loss or damage caused to any prizes at the time of such transportation. The Winners shall bear the shipping, courier or any other delivery cost in respect of the prizes.
The Winners shall bear all transaction charges levied for delivery of cash prizes.

All prizes are non-transferable and non-refundable. Prizes cannot be exchanged / redeemed for cash or kind. No cash claims can be made in lieu of prizes in kind.

S. SELECTION & VERFICATION (Winners & Conditions relating to the Prizes)

1. Selection of Winners

Winners will be decided on the basis of the scores of the Teams in a designated round of the League/s. The Participant/s owning the Team/s with the highest aggregate score in a particular round shall be declared the Winner/s. In certain pre-specified Leagues, Batball11 may declare more than one Winner and distribute prizes to such Winners in increasing order of their Team's aggregate score at the end of the designated round of the League. The number of Winners and the prize due to each Winner in such League shall be as specified on the league page prior to the commencement of the league. Participants creating Teams on behalf of any other Participant or person shall be disqualified. In the event of a tie, the winning Participants shall be declared Winners and the prize shall be equally divided among such Participants. Batball11 shall not be liable to pay any prize if it is discovered that the Winner/s have not abided by these Terms and Conditions.

2. Contacting Winners

Winners shall be contacted by Batball11 or the third party conducting the league on the e-mail address provided at the time of registration. The verification process and the documents required for the collection of prize shall be detailed to the Winners at this stage. As a general practice, winners will be required to provide following documents:

1. User's PAN card, Government-issued residence proof and User's Bank Details.
2. Batball11 shall not permit a Winner to withdraw his/her prize/s/accumulated winnings unless the above-mentioned documents have been received and verified by stipulated by Batball11. The User represents and warrants that the documents provided in the course of the verification process are true copies of the original documents to which they relate. Users are required to provide correct &complete details at the time of registration. Batball11 shall not be responsible for communications errors, commissions or omissions including those of the Participants due to which the results may not be communicated to the Winner.

3. Verification process

Winners who successfully complete the verification process and provide the required documents as specified by Batball11 shall be permitted to withdraw/receive their accumulated winnings (or any part thereof). Batball11 shall not entertain any claims or requests for extension of time for submission of documents. Batball11 shall scrutinize all documents submitted and may, at its sole and absolute discretion, disqualify any Winner from withdrawing his accumulated winnings (or any part thereof) on the following grounds:

1. Determination by Batball11 that any document or information submitted by the Participant is incorrect, misleading, false, fabricated, incomplete or illegible
2. Participant does not fulfill the Eligibility Criteria specified above
3. Any other ground.

4. Processing Prizes

The decision of Batball11 with respect to the awarding of prizes shall be final, binding and non-Contestable. Participants playing the paid formats of the leaguesconfirm that they are not residents of any of the following Indian states - Assam, Odisha, Telangana, Nagaland or Sikkim. If it is found that a Participant playing the paid formats of the League/s is a resident of any of the abovementioned states or any other state where paid format of fantasy gaming are not legal, Batball11 shall disqualify such Participant and forfeit any prize won by such Participant. Further Batball11 may, at its sole and absolute discretion, suspend or terminate such Participant's account with Batball11. Any amount remaining unused in the User's Game Account or Winnings Account on the date of deactivation or deletion shall be reimbursed to the User by an online transfer to the User's bank account on record with Batball11.To the extent permitted by law, Batball11 makes no representations or warranties as to the quality, suitability or merchantability of any prizes and shall not be liable in respect of the same. Batball11 may, at its sole and absolute discretion, vary or modify the prizes being offered to winners. Participants shall not raise any claim against Batball11 or question its right to modify such prizes being offered, prior to closure of the league.Batball11 will not bear any responsibility for the transportation or packaging of prizes to the respective winners. Batball11 shall not be held liable for any loss or damage caused to any prizes at the time of such transportation. The Winners shall bear the shipping, courier or any other delivery cost in respect of the prizes. The Winners shall bear all transaction charges levied for delivery of cash prizes.All prizes are non-transferable and non-refundable. Prizes cannot be exchanged / redeemed for cash or kind. No cash claims can be made in lieu of prizes in kind.

T. Publicity

Acceptance of a prize by the Winner constitutes permission for Batball11, and its affiliates to use the Winner's name, likeness, voice and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any further permissions or consents and / or additional compensation whatsoever.

The Winners further undertake that they will be available for Promotional purposes as planned and desired by Batball11 without any charge. The exact dates remain the sole discretion of Batball11. Promotional activities may include but not be limited to press events, internal meetings and ceremonies/functions.

U. General Conditions

If it comes to the notice of Batball11 that any governmental, statutory or regulatory compliances or approvals are required for conducting any League/s or if it comes to the notice of Batball11 that conduct of any such League/s is prohibited, then Batball11 shall withdraw and / or cancel such League/s without prior notice to any Participants or winners of any League/s. Users agree not to make any claim in respect of such cancellation or withdrawal of the League, or League it in anymanner.

V. Standard Terms and Conditions of Offers

11. The Reward Amount (if any) deposited into the user’s account can be used to join cash Leagues and Leagues on Batball11. However, the Reward Amount (if any) cannot be: (i) used to join 2-member Leagues; or (ii) withdrawn or transferred to any other cash balance account held by you with Batball11 or to any third party account or to any bank/payment instrument account.
12. Scores for Rewind matches will be updated from any innings of both teams scheduled from two different matches played between same teams in any of past season of IPL.
• Selection of innings are from two different random matches with no consideration of actual toss and choices made by team when that match from which innings is selected for scoring took place between teams from any of their past encounter and possible combination of innings

  b. Both second batting innings or

You may purchase Gift Cards through various options available on www.amazon.in, and also use Gift Cards provided to you by third parties in the manner provided hereunder. By purchasing or using a Gift Card, you are agreeing to and accept these terms and conditions.

• Amazon Pay Gift Cards (" GCs ") are issued by the Qwikcilver Solutions Private limited (" Qwikcilver "). Credit and Debit Cards issued outside India cannot be used to purchase Amazon.in Gift Cards.
• To add your GC to your Amazon Pay balance, visit www.amazon.in/addgiftcard
• Beneficiary can apply the 14 digit code (under scratch card) on amazon.in/addgiftcard and add the gift card balance in his/her Amazon.in account. This balance gets automatically applied at the time of next purchase. There is no cap on number of gift cards that can be added to an account.
• Amazon Pay balance is a sum of all balances associated with the GCs in your Amazon.in account.
• Amazon Pay balance are redeemable across all products on Amazon.in except apps, certain global store products and other Amazon.in gift cards.
• Amazon Pay balance must be used only towards the purchase of eligible products on amazon.in
• The GCs, including any unused Amazon Pay balance, expire one year from the date of issuance of the GC
• GCs cannot be transferred for value or redeemed for the cash.
• Qwikcilver, Amazon Seller Service Private Limited (" Amazon ") or their affiliates are not responsible if a GC is lost, stolen, destroyed or used without permission

1. Redemption: Gift Cards may only be redeemed toward the purchase of eligible products on www.amazon.in and any other third party merchants that are enabled to accept the Gift Cards. Purchases are deducted from the redeemer's Gift Card balance. Any unused Gift Card balance will remain associated with the redeemers Amazon Pay balance account and applied to purchases, in order of earliest expiration date. If a purchase exceeds the redeemers Gift Card balance, the remaining amount must be paid by credit card, net banking or debit card. No fees or charges apply to Gift Cards. Qwikcilver may provide Gift Card purchasers with information about the redemption status of Gift Cards that they purchase or use. Certain merchants may provide you services only on the pre-condition that you allow us to hold balances in your Amazon Pay balance: Gift Card till the service completion by the merchant. However, your prior consent would be taken before holding such balances. In such cases, you agree and authorize us to: (i) hold your balance until service completion; and (ii) fail the transaction if your balance in the Amazon Pay Gift Card has expired at the end of the services.

2. Limitations: Gift Cards, including any unused Gift Card balances, expire one year from the date of issuance. You may request for revalidation of any expired Gift Cards. Upon receipt of such request, the Gift Card may be revalidated after due verification and subject to applicable terms and conditions. Gift Cards may only be purchased in denominations of upto Rs. 10,000, or such other limits as Qwikcilver may determine. Gift Cards cannot be used to purchase other gift cards. Gift Cards cannot be reloaded, resold, transferred for value or redeemed for cash. Except as provided hereunder or as per applicable law, amount in your Gift Cards will not be refunded to you under any circumstances. No refund will be provided in cash, at any point of time. Unused Gift Card balances may not be transferred to another users account. No interest will be payable by Qwikcilver on any Gift Card or Gift Card balance. Qwikcilver make no representation or warranty that www.amazon.in will always be accessible without interruption.

3. Fraud: Qwikcilver is not responsible if a Gift Card is lost, stolen, destroyed or used without permission. Amazon Seller Services Private Limited (together with Amazon Pay is referred to as 'Amazon') will have the right to close customer accounts and take payment from alternative forms of payment if a fraudulently obtained Gift Card is redeemed and/or used to make purchases on www.amazon.in.

4. Governing Law and Jurisdiction: These terms and conditions are governed by and construed in accordance with the laws of India. You, Qwikcilver and Amazon each agree to submit to the exclusive jurisdiction of the courts at Bangalore. You agree to indemnify Qwikcilver and Amazon for all claims brought by a third party against it or its affiliates arising out of or in connection with a breach of any of these terms and conditions.

Limitation of Liability: NEITHER QWIKCILVER NOR AMAZON MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY WILL BE THE REPLACEMENT OF SUCH GIFT CARD. IF APPLICABLE LAW DOES NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

6. General Terms: The Amazon.in Conditions of Use apply to Gift Cards. Qwikcilver reserves the right to change these Gift Card terms and conditions from time to time in its discretion and without prior notice to you. All terms and conditions are applicable to the extent permitted by law.

Indian T20 League – 2023 | Leaderboard T&C

Series Leaderboard: EX-showroom amount will be considered for winning of 1st Prize – XUV 700 & 2nd Prize of BMW Bike. Other charges and taxes will be payable by the winner. In case of user demands for winning in Rupees user will get Ex-showroom amount of the prize in his winning wallet after deduction of TDS and other taxes what so ever.

In case of Tie between users, prize pool will be distributed in winning wallet equally & ex-showroom amount will be considered for prize calculation. TDS & Other taxes applicable / will be deducted as per Govt policy.

Weekly Leaderboard: Week will be calculated as per 7 days and dates will be mentioned in each weekly leaderboard section.

Weekly Leaderboard prizes will be distributed within 2 days of completion of the week.

Series Leaderboard Prizes will be distributed within 5 days of Series completion.

All other T&C will be same as per leaderboard T&C mentioned.
